With the new unfair dismissal protections coming into force in January 2027, HR and reward professionals need to understand how the risk landscape has changed.
Qualifying periods for ordinary unfair dismissal protection drop from two years to just six months, but the statutory cap on unfair dismissal compensatory awards will be abolished entirely.
The cushion of a two-year window to resolve underperformance or a cultural mismatch has gone. But the predictability of an employment tribunal exit will also vanish.
